Geragos to Defend Another (alleged) Baby Killer
After nearly a year since Holly Ashcraft was arrested in Los Angeles for the alleged murder and disposal of her newborn baby boy in October 2005, the State of California is conducting a preliminary hearing to determine if Ashcraft will stand trial. Ashcraft’s new counsel of record (as of April 2006) is none other than “high-profile defense attorney” Mark Geragos.
Geragos replaced Ashcraft’s original lawyer, Paul Wallin, who successfully represented the third year USC student in a similar case in 2004 when Ashcraft was suspected (but never arrested or charged) of delivering and disposing of another newborn baby. Thus, we have hit the trifecta of murder cases here: a “Xerox” murder – where an accused gets away with an alleged murder and repeats the modus operandi; the murder of a child by a parent who is described as “very bright, athletic and very upbeat” and “one hell of a good kid” by her family; and our favorite lawyer using his all-too-familiar tactics to exonerate his client.
Ashcraft was arrested after an anonymous tipster called 911 to report finding the newborn in an alley behind a bar popular with USC students. When officers arrived, they found the child's body lying in a cardboard box next to a trash bin. The boy's umbilical cord was still attached, suggesting a medically unattended birth.
Apparently, Ashcraft was so audacious (or careless) she hid the body in an area right behind her second floor apartment.
Back in 2004, she sought medical treatment at an emergency room and doctors determined that she had just given birth. Ashcraft claimed the baby was stillborn and that she “buried it,” but never revealed the location of the baby’s grave. Law enforcement did not pursue charges at the time, but when a second dead infant was linked to Ashcraft within a year, she was not so lucky. Her bail was set at an astonishing $2 million because prosecutors considered her a flight risk. Bail was eventually reduced to $200K so she could post bond and delay the proceedings for as long as possible; which, of course, is Mark Geragos’s indisputable area of expertise.
According to a recent article HERE, DNA of the baby tested in the 99.93 percentile matching Ashcraft’s, and that his death was determined to be a homicide by the results of an autopsy. Geragos’s strategy seems to be to invalidate that his client was pregnant at all:
Mark Geragos, who is representing Ashcraft, ticked off a list of friends and relatives close to Ashcraft, who told investigators they never suspected Ashcraft was pregnant.
When this nonsense fails, expect Geragos to argue that the cause of death is in dispute, there was a conspiracy driven by conservative, right-wing religious fanatics to punish his client (wasn’t there a John Grisham book with this plot?), and that poor Holly is another unfortunate victim of police tunnel vision and politics. I wonder if he’ll turn this into a pro-choice debate to attract the media? This case hasn’t received much attention, but Geragos’s presence is most certainly a harbinger of disaster.

I don't want to turn this into a pro-choice/pro-life debate either but my first thought is what a "throw away" society we have become. Inconvenience? Get rid of it. Don't want it any more? Throw it away. We have disposable everything and now it's come down to disposable children. I'm glad MG is representing her because that means she's sure to stay in jail.

A girl in that predicament has many, many options.
She could have arranged for a private adoption (and could have found parents in a heartbeat) and had the medical care taken care of and given that baby boy to a loving family.
She could have aborted early on. She was at USC and could have gotten counseling in any number of places.
She could have brought the baby to the hospital or a fire station (one was about 45 seconds from her apartment) and given it safe harbor with no questions asked.
And, I'm not even going to go into the birth control options or abstinence options she had after the first "stillborn" a year previously. She reminds me of a modern Jackie Peterson with less regard for human life.

As most know, California has a Safe Haven law whereby any newborn can be taken within 72 hours to any hospital.
Personally, I think it should be extended beyond the 72 hours, and many states have extended it to 30 days.

Original prosecutor resigned (The Daily Trojan reports):
Taking over the case is Deputy District Attorney Franco A. Baratta, who Aceves said was "one of our top attorneys" in the Family Violence Division of the District Attorney's Office.
Baratta was unavailable for comment Thursday afternoon.
Defense attorney Mark Geragos said Baratta is "the cream of the crop at that office.
"I have an enormous amount of respect for Franco," Geragos said.

Ashcraft, a third-year USC student, is charged with murder and child abuse after the body of an infant was found next to a dumpster behind the 29th Street Café.
Ashcraft's mother, Marlene Zentz, claimed the child, in lieu of a next-of-kin, Dec. 9 to arrange for burial, but on May 8, after being refrigerated for five months at Hillside Mortuary, the child was returned to the coroner's office, Harvey said.
"A body that's deemed abandoned is the responsibility of the coroner to make ultimate disposition," Harvey said.

Both these cases make me absolutely sick to my stomach! There is no excuse for bearing a child and then killing it, and the case of the two girls with their pathetic teen pregnancies...that is so sickening as to drive a person to drink!
When I think about all the people I know who would give anything they had to have a baby, and would have cherished any or all of those poor babies, I say throw the book at both killers.

Preliminary autopsies on the dead children Sunday appear to show they were drowned, Ace Hart, a deputy St. Clair County coroner, told The Associated Press.

I have a question.
The 72 hour number has been bantered about, with "some States" extending the numbers to 30 days.
WHY is there a Number AT all? Apparently the women and men that resort to killing their children feel that they have no other option.
Just curious if there is a reason for a time limit on the little ones life and their parents' decision.
Maybe I missed something????

Someone was asking about Ashcraft's financial status. She was at USC on a scholarship, supposedly. Her parents (divorced) are in Montana, and her dad hadn't even spoken to her in over 3 years, so that's a bad sign.
It's possible GerEgo is doing this one pro bono, but I seriously doubt it. I would venture to guess the family has pooled its resources. She had an attorney already who was not free. It's possible since she's a student (and 21) she would qualify for a public defender.
Obviously, her family wants her to "walk." Otherwise, they would not be underwriting this defense.

If she bore these babies alone, that speaks loud and clear to her intent. Those who advocate home birth realize that attendants of some sort are a requirement--midwives, etc. If your intent is to have a healthy baby, you make sure all the safeguards are in place.

Six months ago Keith Carradine, claiming "malicious and illegal tactics" were used in his 1993 divorce case, sued Pellicano after learning he was among those whose phones were tapped. And who did actor Keith Carradine hire as attorney? Mark Geragos.
